You showed why its an issue by providing the loophole yourself.

If there is even the slightest way in, they will find a way in. Whether its for pure pedo reasons or to be "affirmed" in some specific way, they will abuse every loophole and inch you give them towards that goal.

Even if they don't have the right to be there, they will make enough trouble and accuse anyone who calls them out of enough "hate speech/crimes" that people just put their head down and let it happen anyway.
