No, we didn't check with XBOX, we checked with the card the purchases where made on. They said x box can tell people whatever they want, that doesn't make it so.

There's no legal way to own the content you pay for, the only way to own anything now days is through piracy.
Digital IP isn't the same as physical. That's why even if you purchase a tangible copy, you still download Gigs. That's for them not you.

Be careful about time limits for charge backs. I think the typical policy is 60 days after the transaction.
