That 5% is actually the group saying that 95% of society is actually 20% of society, and since 20% of society won't follow the rules, they need a Rainbow version of Punisher.
There is a fundamental truth that some people who exist outside your moral universe are effectively your enemy, and destroying them is actually necessary. That, of course, isn't any way to run a society, but by definition, enemies don't exist within a society because they are your enemies. If you rape a baby, you are outside the moral universe for most societies, and are therefore an enemy.
The problem with the Left is that that approach is how they approach all relationships. When you are operating solely from a Melian Dialogue, everyone is your enemy until they submit to you. Rousseauian philosophy requires a reign of terror for this very reason: to use unlimited coercion to compel people into the "general will" makes them your enemy until they comply.
The way to deal with those people is to properly recognize them as the attackers that they are, exclude them from your social sphere, and show now tolerance to them. Tolerance was our greatest mistake, as it is a Neo-Liberal value build on communist support for agitation. Our job is to build a parallel functioning society right through their madness and offer them nothing until they repent. We don't need a Punisher, we need construction workers.
We are in furious agreement.
Still, the Punisher is wonderful as both a thought experiment and as a parable. Even as an idea the Punisher frightens the living shit out of Socialists.
Of course he scares the shit out of them.
People who have never faced consequences are horrified by not only the concept of punishment, but the idea of disproportionate and irreparable punishment.
