I can hardly think of a situation where this is appropriate. if she merely spit on the ground next to the protester, nothing should be done. if her spit was directed at the target and landed on the target, I feel like that's reasonable grounds for some kind of assault charge.
All this said, you can be black and hold a sharp machete literally to a white man's neck and still not face jail time at this point, so it's hard to believe that this is not a racially motivated sentence.
