I assume is up to each Country. If the country denies it but the EU allows it then the deny works. If the EU prohibits or forces something then it expects countries to enforce the regulations, if they do not they get restrictions from EU.
The same as it allows discrimination against white people but your country can still uphold a no-discrimination law, although from what I've seen corporations don't give a shit about it and discriminate anyway.
