It's more along the lines of, if you can dismiss a prosecutor because they do not share your beliefs, then why can't you dismiss a judge and jury of the same thing. And at least with a jury you'd have a stronger argument that those who are not of the same race and sex as you are not your peers than dismissing a judge and prosecutor.

You can dismiss jury for that though, and you dismiss a judge by the appeals process, which includes mistrial as a reason.
