Is a car "out of control" if there is a working steering wheel, brakes, gas, the works, and a driver who is awake and aware sitting properly in the driver's seat... Who chooses to jam on the gas with no hands on the wheel and eyes closed?
I'd call that more "purposeful and reckless endangerment" than "out of control", personally, but I guess it is a matter of philosophy.
