Do you have any information on those court cases? California especially doesn't seem like one that would rule in favor of religious freedom over lesbians.
This is what I found, but it says the supreme court of california sided with the lesbian. Granted it's been 13 years, but I could swear a federal court said they could.
As you said, this was 13 years ago (the case actually started 8 prior, so really we're talking 21 years ago) AND the law didn't prevent them it was one particular doctor. Second, the courts ruled against religious beliefs here. Finally, this was an optional treatment (fertility), this wasn't anything that prevented someone from sickness.
I should never have given you the link you're obviously not going to see what I'm trying to put in front of you. This was but one example and if it wasn't for the cali supreme Court stepping in, it would have stayed. And the federal courts have sided with religious freedom time and time again.
