What happens if everyone "judges by content of character" and it happens that, on average, people of certain racial groups have better or worse character than others? By definition our legal system would declare that "racial discrimination" due to "disparate outcomes" doctrine when in this hypothetical scenario no such racial discrimination had in fact occurred.
In this hypothetical universe the legal system would in fact be tilted in favor of finding racists everywhere, even if they in fact didn't exist. It may even have the side effect of not racist people becoming racist as they started to think to themselves "I know I'm not racist, and yet these differences exist. Maybe people are different"
But the idea that disparate impact is racist is absurd.
And yet our entire legal system in the US is based on that assumption.
But we aren’t all alike. Some people will work harder, some are smarter, some have more athletic abilities, and the list goes on.
You make a good point about people being different but individuals can surprise you. This also ties into the problem where people seem to fear holding people accountable
You think they don’t know? They claim meritocracy is racist because it disadvantages black people. What does that say of their estimation of blacks?
They know. Blacks are their tool to take and hold political power. Everything else is a lie.
The Woke know, and the Race Realists know; but their solutions are obviously incompatible.
Most other people think everything is purely cultural and that they can freely discriminate on that basis. But even if they're correct, if that culture correlates with race to a statistically significant degree the law would prohibit you from discriminating based on "culture" because that discrimination wouldn't equally affect all races.
It's those people I try to reach with that little elevator pitch.
