There is nothing official, no document or written policy that someone can use as Exhibit A in court and say, "See, this right here is the problem, judge." That means that nobody can sue, because there is no cause to sue, because there has been no injury.
No sate AG can sue to stop it in Federal court, which only leaves civil remedies by individual employees against their employer.
Many corporations are going to get raped up the ass by Religious Freedom Restoration Act, because they were explicitly denying religious exemptions across the board. That doesn't help employees in the here and now, though, because those cases are going to take months if not years to resolve.
It's the big government equivalent of 'Will no one rid me of this troublesome priest?'. Try and make the employer the hatchet man and absolve the important people, the government, from responsibility.
