I can't comment about the Lupin the 3rd stuff as I barely know about the series outside of the few episodes I've seen during the old days of broadcast TV and I have no idea about the JoJo's Bizarre Adventure as I haven't seen past the second season.
Not necessarily, I remember that Speed Grapher used "Girls on Film" by Duran Duran for its opening titles. When it was licensed in the US, Funimation had to use an instrumental track from the soundtrack instead, because Duran Duran caught wind and they hadn't given permission.
If there was a lawsuit to be had, it would have happened long ago against the Japanese company that owns the IP of MHA.

That is a copyright issue and is related to licensing issues. Not really the same thing being brought up here.
