The case where this was used was to shut down the free speech of those opposed to the United States involvement in WWI (later overturned of course). If anything AT ALL has first amendment protection it's speech critical of government action. You can imagine where this goes, "denial of climate change is yelling 'fire' in a crowded theater", "opposing critical race theory is yelling 'fire' in a crowded theater", "claiming Biden has been replaced by a hologram is yelling 'fire' in a crowded theater."
You literally can yell fire in a theater though and it be totally legal... you know when there is an actual fire. It’s the act of causing a dangerous panic for no reason that is the problem.
... so why not remove the first amendment? Or is he leaving that until he's removed all the guns after scrapping the second?
