IANAL The court needs to have a remedy. If there are no damages, what are you doing in court? What do you expect the court to do? The judge will probably ask those question point blank if you can't show why you are injured.

My point about WF is that he needs to dissuade the judge from thinking that this the appropriate way for society to function.
