If she is ever "restored to competency" then she will stand trial. Lori Vallow who killed her own kids was deemed incompetent at first, yet she was still sentenced to life in prison eventually.

Cuyahoga County Common Pleas Judge John Russo issued the ruling Friday. He said Bionca Ellis, 33, of Cleveland, will remain hospitalized indefinitely and could eventually stand trial if she improves.

Lori avoided the DP (death penalty, not the other thing...) on a technicality because the prosecution screwed up. It was on the table.
