Anyone noticed this, all the big corps putting forced arbitration back into their terms-of-service? Roku most notoriously, but they all seem to be bringing it back? Discord the other day, some other corp I cant remember the week before...
What's up with that? I think it's related to them all being scared away from it by the owen benjamin lawsuit, but when the Californian courts scuppered that (you can be right morally and legally, but if you aren't politically, go fuck yourself), they want to bring it back.
And did anyone have a Roku tv with that forced message?
Basically if they force arbitration they don't need to go through courts where it isn't the fees that scare them, this one word terrifies them beyond anything else:
Discovery
Disney literally settled their case with Florida losing Reedy Creek on that ALONE because they were at discovery. So many companies in the US have papertrails from DEI to just backdoor deals with governments that they desperately do not want discovery even if it means they open their wallets to escape it.
mmmm good point
The threat of discovery, i forgot about that, yeah that's worth paying to avoid if you've got something to hide, as they surely do.
And I'm sure the arbitrators have changed the fee schedules in the meantime anyway
100% Disney is going to try and settle Carano's case too, though since she is bankrolled by the Musk. She might just decline to settle and go for that juicy discovery... I sure hope so atleast.
