The construction is a meaningless piece of paper at this point. They didnt have the constitutional right to mandate masks and vaxxes, but they did anyway.
It's not a lost cause. It would be surprisingly easy--by which I mean not that many steps, even if the steps are implausible--to fix.
State legislatures have to go back to "emergency" provisions that by and large were instituted as a reaction to 9/11, and raze them. There's some awful deference to State Health stasi as well that needs to go. On the Federal level, we are right in the nascent stage of correction, with the Supreme Court rolling up their sleeves and discarding totally bonkers precedent. D.C. just lost a ton of power, and hopefully that will continue.
