He's just an old man who still believes this is the country he grew up in. He probably naively trusts that the jury will acquit Kyle because of the sheer propensity of evidence in his favor. A jury acquittal plays better than mistrial with prejudice, though I suppose that's me being naive because it doesn't matter to the current media either way
An acquittal also stops them from going after Kyle again on the same charges with a different judge which could happen if he threw it out or if they got the mistrial they seemed to be aiming for.
there's a reason the words "with prejudice" are present in the motion for mistrial that the defense filed.
If it is "merely" declared a mistrial, it'd go down as you say.
But, if it is declared "with prejudice", then they literally cannot charge Kyle with the same crimes from the same event.
Sure, they'll near-certainly shop around for a libtard "judge" to put Kyle on trial for a different litany of "crimes" from the same event, but that's a whole fuck-load harder than just repeat charging him with the exact same spurious bullshit.

Mistrial with prejudice also precludes retrial.
State could appeal in that case and potentially get the "with prejudice" removed, depending on how the appeals court is feeling.
