Ugh I hate HOA’s. Anyway, the descendants won’t allow the cemetery to be moved, and, frankly I don’t see how this is the HOA’s problem. The developer made those promises. The home owners could dissolve the HOA tomorrow and then what? Then who will maintain it?
The HOA can do literally nothing with that parcel of land other than pay taxes on it. What they should do is just give the deed to the cemetary to that family and let them deal with it if it’s so important to them. They’d really be losing nothing by doing so, other than the tax burden.
