12 National Guard Members Removed From Inauguration Duties Amid Extremist Threats
Two of them made threatening comments toward lawmakers, and one expressed support for President Trump. The others were removed for a wide variety of reasons.

WASHINGTON — Twelve National Guard members have been removed from duties related to the inauguration of President-elect Joseph R. Biden Jr., two of them for expressing anti-government sentiments, Defense Department officials said on Tuesday.
Two of the members were removed over texts and social media posts that made threatening comments toward political officials, Pentagon officials said. They declined to specify the exact nature of the threats.
“I will share that they were inappropriate ,” Gen. Daniel R. Hokanson, the chief of the National Guard Bureau, told reporters during a telephone briefing.
Two officials described the texts as broad in nature — not directed specifically at Mr. Biden or Vice President-elect Kamala Harris, but rather at lawmakers as a whole. One of the service members removed, the officials said, made a point of expressing support for President Trump in addition to making menacing comments.

Sacramento Mayor Darrell Steinberg on Monday condemned a group of left-wing protesters who threw rocks at his house in the Pocket neighborhood, destroyed a cherished homemade art piece and repeatedly shouted his children’s names in what he called an “attack” on his family and his community.
“This was not protest. This was anarchy,” Steinberg said in a written statement about the vandalism and damage to his home. “You want to challenge me, challenge me at City Hall. Challenge me in the community. Challenge me at the ballot box.”
After the mayor’s home was vandalized, the officers moved in and dispersed “the destructive demonstration,” police officials said in a news release Monday afternoon. Sacramento Police Chief Daniel Hahn said his department supports everyone’s First Amendment rights to free expression, but what happened at the mayor’s house was not free speech.

There is a vigorous debate about whether the community care exception can apply to searches of a person’s home as well as of their car. Vehicles have always had less 4th Amendment protection than homes, which are considered a person’s most private sphere. Federal courts have been divided on this question and the Supreme Court has not ruled on it until now.
The Court has just announced that it will hear arguments next month on a case that presents this issue: Caniglia v. Strom. In this case, Mr. Caniglia was arguing with his wife and melodramatically put an unloaded gun on the table and said “shoot me now and get it over with.” His wife called a non-emergency number for the police who arrived shortly thereafter. The police disagreed about whether Mr. Caniglia was acting “normal” or “agitated” but they convinced him to take an ambulance to the local hospital for evaluation. The police did not accompany him.
While he was on his way to the hospital, Mrs. Caniglia told the police that her husband kept two handguns in the home. The police decided to search his home for the guns without obtaining a warrant. (Mrs. Caniglia’s consent to have the police search their home was legally negated because the police untruthfully told her that her husband had consented to the seizure of any guns.) The police located and seized the two guns. Mr. Caniglia sued for the violation of his 4th Amendment right to privacy and his 2nd Amendment right to keep handguns in the home for self-protection.
The 1st Circuit Court of Appeals (which is the federal court just below the Supreme Court in Caniglia’s jurisdiction) sided with the police. The court wrote: “At its core, the community caretaking doctrine is designed to give police elbow room to take appropriate action when unforeseen circumstances present some transient hazard that requires immediate attention. Understanding the core purpose of the doctrine leads inexorably to the conclusion that it should not be limited to the motor vehicle context. Threats to individual and community safety are not confined to the highways.”

Hold gun manufacturers accountable.
In 2005, then-Senator Biden voted against the Protection of Lawful Commerce in Arms Act, but gun manufacturers successfully lobbied Congress to secure its passage. This law protects these manufacturers from being held civilly liable for their products – a protection granted to no other industry. Biden will prioritize repealing this protection.
Get weapons of war off our streets.
The bans on assault weapons and high-capacity magazines that Biden, along with Senator Feinstein, secured in 1994 reduced the lethality of mass shootings. But, in order to secure the passage of the bans, they had to agree to a 10-year sunset provision and when the time came, the Bush Administration failed to extend them. As president, Biden will:
Ban the manufacture and sale of assault weapons and high-capacity magazines.
Regulate possession of existing assault weapons under the National Firearms Act. Currently, the National Firearms Act requires individuals possessing machine-guns, silencers, and short-barreled rifles to undergo a background check and register those weapons with the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). Due to these requirements, such weapons are rarely used in crimes. As president, Biden will pursue legislation to regulate possession of existing assault weapons under the National Firearms Act.
Buy back the assault weapons and high-capacity magazines already in our communities. Biden will also institute a program to buy back weapons of war currently on our streets. This will give individuals who now possess assault weapons or high-capacity magazines two options: sell the weapons to the government, or register them under the National Firearms Act.
Reduce stockpiling of weapons. In order to reduce the stockpiling of firearms, Biden supports legislation restricting the number of firearms an individual may purchase per month to one.
Keep guns out of dangerous hands.
Biden will enact universal background check legislation and close other loopholes that allow people who should be prohibited from purchasing firearms from making those purchases. Specifically, he will:
Require background checks for all gun sales.
Biden will enact universal background check legislation, requiring a background check for all gun sales with very limited exceptions, such as gifts between close family members. This will close the so-called “gun show and online sales loophole” that the Obama-Biden Administration narrowed, but which cannot be fully closed by executive action alone.
Reinstate the Obama-Biden policy to keep guns out of the hands of certain people unable to manage their affairs for mental reasons, which President Trump reversed. In 2016, the Obama-Biden Administration finalized a rule to make sure the Social Security Administration (SSA) sends to the background check system records that it holds of individuals who are prohibited from purchasing or possessing firearms because they have been adjudicated by the SSA as unable to manage their affairs for mental reasons. But one of the first actions Donald Trump took as president was to reverse this rule. President Biden will enact legislation to codify this policy.
Close the “hate crime loophole.” Biden will enact legislation prohibiting an individual “who has been convicted of a misdemeanor hate crime, or received an enhanced sentence for a misdemeanor because of hate or bias in its commission” from purchasing or possessing a firearm.
Close the “Charleston loophole.” The Charleston loophole allows people to complete a firearms purchase if their background check is not completed within three business days. Biden supports the proposal in the Enhanced Background Checks Act of 2019, which extends the timeline from three to 10 business days. Biden will also direct the Federal Bureau of Investigation (FBI) to put on his desk within his first 100 days as president a report detailing the cases in which background checks are not completed within 10 business days and steps the federal government can take to reduce or eliminate this occurrence.
Close the “fugitive from justice” loophole created by the Trump Administration.
Because of actions by the Trump Administration, records of almost 500,000 fugitives from justice who are prohibited from purchasing firearms were deleted from the background check system. The Biden Administration will restore these records, and enact legislation to make clear that people facing arrest warrants are prohibited from purchasing or possessing firearms.
End the online sale of firearms and ammunitions.
Biden will enact legislation to prohibit all online sales of firearms, ammunition, kits, and gun parts.
Create an effective program to ensure individuals who become prohibited from possessing firearms relinquish their weapons.
But we lack any serious tool to ensure that when someone becomes newly prohibited – for example, because they commit a violent crime – they relinquish possession of their firearms. There are some promising models for how this could be enforced. For example, California has a mandatory process for ensuring relinquishment by any individual newly subject to a domestic violence restraining order. As president, Biden will direct the FBI and ATF to outline a model relinquishment process, enact any necessary legislation to ensure relinquishment when individuals newly fall under one of the federal prohibitions, and then provide technical and financial assistance to state and local governments to establish effective relinquishment processes on their own.
Incentivize state “extreme risk” laws.
Extreme risk laws, also called “red flag” laws, enable family members or law enforcement officials to temporarily remove an individual’s access to firearms when that individual is in crisis and poses a danger to themselves or others. Biden will incentivize the adoption of these laws by giving states funds to implement them. And, he’ll direct the U.S. Department of Justice to issue best practices and offer technical assistance to states interested in enacting an extreme risk law.
Put America on the path to ensuring that 100% of firearms sold in America are smart guns.
Today, we have the technology to allow only authorized users to fire a gun. For example, existing smart gun technology requires a fingerprint match before use. Biden believes we should work to eventually require that 100% of firearms sold in the U.S. are smart guns.

Marc Elias, the election lawyer who represented Democratic challenges to state rules throughout the 2020 election, alleged in a court filing this week that a close congressional race in upstate New York was marred by faulty voting machines.
In the congressional race for New York’s 22nd district, Republican Claudia Tenney currently leads incumbent Democrat Anthony Brindisi by a razor-thin margin of 125 votes. Tenney declared victory on Tuesday, though challenges continue.
In this case, there is reason to believe that voting tabulation machines misread hundreds if not thousands of valid votes as undervotes, (supra at 4), and that these tabulation machine errors disproportionately affected Brindisi, (id.). In addition, Oswego County admitted in a sworn statement to this Court that its tabulation machines were not tested and calibrated in the days leading up to the November 3, 2020 General Election as required by state law and necessary to ensure that the counts generated by tabulation machines are accurate.
In addition, as Breitbart News has noted, “Elias was responsible for hiring opposition research firm Fusion GPS, on behalf of Hillary Clinton’s campaign and the Democratic National Committee, [which produced] the fraudulent “Russia dossier” on then-candidate Donald Trump in 2016.”

I was reading about this on my Twitter account, I guess, and people were reminding people of Anwar Sadat and Indira Gandhi who were killed by their own people. I was thinking, the guard is 90 some odd percent, I believe, male.
Only about 20 percent of white males voted for Biden. You have got to figure that the guard, which is predominantly more conservative and I see that on my social media, and we know it, they are probably 25 percent of the people that are there protecting us who voted for Biden.
The other 75 percent are in the class that would be the large class of folks who might want to do something. And there were military people and police who took oath to defend the Constitution and to protect and defend who didn’t do it who were in the insurrection. So it does concern me. FBI vetting Guard troops in DC amid fears of insider attack

Army Secretary Ryan McCarthy told The Associated Press on Sunday that officials are conscious of the potential threat, and he warned commanders to be on the lookout for any problems within their ranks as the inauguration approaches. So far, however, he and other leaders say they have seen no evidence of any threats, and officials said the vetting hadn’t flagged any issues that they were aware of.
”We’re continually going through the process, and taking second, third looks at every one of the individuals assigned to this operation,” McCarthy said in an interview after he and other military leaders went through an exhaustive, three-hour security drill in preparation for Wednesday’s inauguration. He said Guard members are also getting training on how to identify potential insider threats.

A Florida man arrested Wednesday is accused of using social media platforms to mislead voters ahead of the 2016 presidential race between Donald Trump and Hillary Clinton.
Douglass Mackey, a 31-year-old social media influencer who operated under the online alias "Ricky Vaughn," was charged with conspiring to spread disinformation designed to "deprive individuals of their constitutional right to vote."
William Sweeney Jr., the assistant director of the FBI's New York field office, said in a statement that what Mackey allegedly did "amounted to nothing short of vote theft."
"It is illegal behavior and contributes to the erosion of the public's trust in our electoral processes," Sweeney Jr. added. "He may have been a powerful social media influencer at the time, but a quick Internet search of his name today will reveal an entirely different story."

A Trump supporter who attended the peaceful rally that preceded the Capitol Hill riot revealed to The Post Millennial that she was flagged with facial recognition technology and interrogated by Homeland Security while flying home from vacation last week. Then FBI agents appeared at her house.
When 54-year-old Dana Kurtbek of Bucks County, Pennsylvania, travelled to Mexico with her daughter, the conservative woman was held at Philadelphia Airport for intensive screening conducted by the Transportation Security Administration—even though she is enrolled in the expedited TSA PreCheck program—and missed her American Airlines flight.
Later that week on Friday night, two FBI agents appeared at her front door, informing Kurtbek that the bureau had received two reports from anonymous sources claiming that she was inside the Capitol building during the incident. The agents cited a screenshot captured from a CNN video that depicted a woman identified by authorities as Kurtbek.
"Since I know I was nowhere near the Capitol, I laughed and asked to see the photo and if it was possible to know who identified me because they are absolutely lying and wasting taxpayer money by sending them both out to my home," Kurtbek recounted.
When she prompted the main officer for his business card, he said he was out and flashed his badge. Kurtbek also asked if she could record the conversation, but her request was denied.

FBI raids homes of 2 men who held rally on eve of Capitol attack

FBI spokeswoman Laura Eimiller confirmed that federal agents executed search warrants last week at two properties in Orange County, California, which public records indicate belong to Russell Taylor and Alan Hostetter. The two men run the American Phoenix Project, which co-sponsored a pro-Donald Trump rally near the Supreme Court on January 5, one day before the attack.
An FBI spokesperson told CNN the search was conducted at the property Taylor owns at 6 a.m. Wednesday. CNN obtained photos and videos of FBI agents at his house hours later.
Spokespeople for the FBI and the Justice Department declined to comment further about the raids or what investigators were searching for, noting that the case files are still sealed.
A lawyer for Taylor, Dyke Huish, told CNN that the agents were "just gathering information on people that were at or near the Capitol building on the day in question," referring to January 6. Huish said Taylor "cooperated with investigators" and the search was finished "without incident." Eimiller, the FBI spokeswoman, said "no arrests were made" during the searches.
Photos from Hostetter's Instagram and photojournalists place him and Taylor just outside the Capitol building during the riot. An AFP photographer snapped an image of Taylor giving police the finger around 4:30 p.m. near the North side of the Capitol, near the entrance to the Senate.
Two other photos show Taylor near a police line on the North side of the Capitol. One photo shows him using his body to push against a police line; the other shows him near a police line with what appears to be a gas mask.
He later wrote on Facebook that he never made it inside.

Joan Donovan, the research director of Harvard University’s Shorenstein Center on Media, Politics and Public Policy, suggested that the Biden administration could set up a “truth commission,” similar to the 9/11 Commission, to investigate the planning and execution of the Capitol siege on Jan. 6. This effort, she said, would ideally be led by people with deep knowledge of the many “networked factions” that coordinated and carried out the riot, including white supremacist groups and far-right militias.

These experts were heartened that the Biden administration had already announced a “comprehensive threat assessment” of domestic extremism after the Capitol riots. They noted that counterterrorism efforts had historically been used to justify expanding state power in ways that end up harming religious and ethnic minorities, and that today’s domestic extremism crisis didn’t map neatly onto older, more conventional types of terror threats.

Instead, they suggested using new and narrower labels that could help distinguish between different types of movements, and different levels of influence within those movements. “If each of them are doing it distinctly and independently, you run the risk of missing connections, both in terms of the content and in terms of the tactics that are used to execute on the campaigns,” Ms. DiResta said.

This task force could also meet regularly with tech platforms, and push for structural changes that could help those companies tackle their own extremism and misinformation problems. And it could become the tip of the spear for the federal government’s response to the reality crisis.

After all, many people are drawn to extremist groups like the Proud Boys and conspiracy theories like QAnon not because they’re convinced by the facts, but because the beliefs give them a sense of community or purpose, or fills a void in their lives.
One effective countermeasure, Mr. Clark suggested, could be a kind of “social stimulus” — a series of federal programs to encourage people to get off their screens and into community-based activities that could keep them engaged and occupied.

Will Wilkinson is a vice president at the left-leaning Niskanen Center, a contributing writer at The New York Times, and someone who has frequently quarreled with me about so-called cancel culture. (I think it's generally bad when people are fired, expelled, or dragged on social media for saying stupid or poorly phrased things they quickly come to regret; Wilkinson has suggested to me that I've made too much of this problem.)
On Wednesday, Wilkinson tweeted, "If Biden really wanted unity, he'd lynch Mike Pence."
Lynching humor is virtually never a good idea, and this joke was especially badly executed. (Wilkinson said he was making a joke not at the former vice president's expense, but in reference to the Capitol rioters who had expressed a similar sentiment. The joke being that this time it was the far right calling for violence against a Republican official rather than the left.)
Nevertheless, the Niskanen Center fired Wilkinson and made it clear that they did so explicitly because of the tweet. "The Niskanen Center appreciates and encourages interesting and provocative online discourse," wrote Niskanen President Jerry Taylor in a statement. "However we draw the line at statements that are, or can in any way be interpreted as, condoning or promoting violence."
The New York Times, too, may take action. "Advocating violence of any form, even in jest, is unacceptable and against the standards of The New York Times," a Times spokesperson told Fox News. "We're reassessing our relationship with Will Wilkinson."

WASHINGTON — In the aftermath of last week’s deadly assault on the Capitol by supporters of President Donald Trump, members of Congress are expressing something once unthinkable: that some of their own colleagues may be endangering their lives. Not in a rhetorical sense, but in a direct and immediate way.
“It’s the most poisonous I’ve ever seen,” Rep. Don Beyer, D-Va., told NBC News in an interview. “There’s the overall sense that maybe if some of them have guns, and likely the ones who are more into conspiracy theories and QAnon with the pedophilic Satanic rings, are we safe from them?”
Since the deadly riot on January 6, lawmakers have suggested — not, so far, backed up by evidence — that far right colleagues may have helped plan or guide the attack itself.
One House freshmen is pushing to carry firearms on Capitol grounds and another says they were armed with a gun during the attack, further putting their colleagues on edge. With Speaker Nancy Pelosi’s support, security officials have installed metal detectors outside the House floor, causing tension with some Republicans and effectively suggesting that members themselves may pose a danger.
With members traumatized, hundreds of members of the National Guard sleeping in congressional hallways, and warnings from authorities of continued threats, suspicion and rumor are running rampant.
"There were QAnon and white supremacist sympathizers, and frankly white supremacist members of Congress, in that extraction point who I have felt would disclose my location and would create opportunities to allow me to be hurt, kidnapped, et cetera," Ocasio-Cortez, a highly visible progressive and frequent target of conservative media, said in a speech Tuesday streamed live on Instagram.
Rep. Mikie Sherrill, D-N.J., has said she witnessed lawmakers holding tours around the Capitol the day before the attack that she believes may have been part of a “reconnaissance” effort for the rioters. There is no current evidence of such wrongdoing and Sherill has not publicly disclosed any names. But she and over 30 other Democrats have signed onto a letter asking authorities to investigate the claim.
“I was flat on the ground as other members were calling loved ones because they thought that might be the last phone call they made,” Sherrill said on "The Rachel Maddow Show" Wednesday. “To imagine that colleagues of mine could have aided and abetted this is incredibly offensive and there is simply no way they can be allowed to continue to serve in Congress.”
“It’s very disturbing that [it’s] this combined threat,” Rep. Ann McLane Kuster, D-N.H. told NBC News. “The threat from within and the threat from without.”

John Sullivan was at the front of the Trumpist mob in the Capitol, egging it on as he recorded the rampage. The far-right is pointing to him as proof of Antifa’s role in the riot. But leftist activists call him a dangerous provocateur and have banished him.
Many activists have characterized Sullivan as an agent provocateur, while others have speculated that he is a law enforcement asset. What all seem to agree on is that he thrives off of creating as much chaos as possible.
“If there’s violence to instigate, he will raise it to another level. But he’s not the one that does it,” Sean Michael Love, a DC-based BLM activist and publisher of Blackhouse News, said of Sullivan. “And that’s a dangerous type of person. That’s one of the most dangerous types of people to me.”
“John knew somehow that people were considering storming the Capitol,” Sacker told me. “He had had intelligence days before, and I didn’t believe him. I never thought that something like that would happen. And then when we showed up at the Capitol, there were thousands and thousands of people there. I didn’t think that we would be able to document what was going on. So when I said we did it, I was just shocked that we like got in there at all, and that we were on the front lines of being able to tell the story.”
After over a decade of training to compete in the Olympics as a speed skater, then rising through the corporate ranks as a marketing whiz, Sullivan abandoned his normie life goals and founded an anarchic protest outfit called Insurgence USA. Soon enough, he was moving crowds with a megaphone and recording the results. An FBI bulletin disseminated to the media reported that armed pro-Trump protests are planned in 50 states on Inauguration Day. An outlier among those protests is one recently advertised on John Sullivan’s Insurgence USA website calling for an “armed march” at the Utah State Capitol. The flier made no mention of Black lives, or Black liberation. Instead, it called to “end government control.”

You might be wondering about the news media's coverage of Trump's trip to Alamo, Texas on Tuesday. Ostensibly he is going there to celebrate the southern border wall. But there's a lot of concern about what he'll say and how he'll say it. Let me just reiterate what I said on CNN Monday morning: Responsible TV networks will not air Trump live and in full. Not after his incitement last week. But I think we'll see a repeat of last Wednesday's rally coverage, meaning that Fox and other pro-Trump networks will air Trump live, while other outlets will exercise editorial judgment and ingest what he says, then decide if any of it is newsworthy. Maybe Fox management will prove me wrong and skip the speech, we'll see...

How MAGA Extremism Ends
If Trump keeps losing, the risk of future violence will abate.

For the past four years, Donald Trump has been playing two roles: one as president, and the other as the rallying point for a coalition of theocrats, internet fantasists, white supremacists, and various other authoritarians who are in no way committed to peaceful transitions of power. Wednesday’s insurrection at the United States Capitol made Trump’s latter role all too clear.
Before he incited the deadly attack, Trump still might have had a future in politics. Even after losing his reelection bid, Trump had been well positioned to launch his own media brand, maintain his spell over other Republicans, and make life hard for his Democratic successor, Joe Biden. But Trump’s role in the violent insurrection—which was intended to overturn the 2020 election and literally drove members of Congress into hiding—could and should turn him into an outcast. He’s been banned from Twitter. Many Republicans are distancing themselves. Some of his Fox News proxies are expressing shock at his actions. Trump even lost Bill O’Reilly and the PGA of America.
The decision of what to call the insurrectionists at the Capitol is politically fraught, but it surely fits my definition of domestic terrorism. People do not bring zip-tie handcuffs to the Capitol because they only want to exercise their First Amendment rights. No one who carries the parts for a makeshift gallows can be counted on to stick to peaceful protest. The insurrectionists had the same intention as other terrorist groups throughout history: to exert influence over the government by violently intimidating public officials and average citizens.
Viewing Trump’s insurrection through a counterterrorism lens unlocks some insights about how to deradicalize his most violent supporters. Successful efforts to fight terrorism begin at the top. An ideology may survive and linger, but to curtail a terror threat requires what counterterrorism experts call “leadership decapitation.” (The meaning is figurative.) Society is more likely to heal when an extremist group’s ideological leader is isolated and damaged in the eyes of his supporters.
Keeping Trump in office until January 20 won’t assuage the supporters who falsely believe that the election was stolen from him, but removing him from office a week early would emphasize that he is losing. Recruitment is easier for a winning team. As the Islamic State and al-Qaeda both discovered after their apexes, getting people to take up arms is harder when the cause is in decline.
He has limited access to effective communication forums, most notably Twitter and Facebook. The platforms’ decision to suspend his accounts was controversial, but deplatforming is a successful counterterrorism technique that, although it may galvanize diehards, impedes a movement leader’s ability to reach new members. The MAGA-world leadership team is in disarray; Pence plans to attend Biden’s inauguration. In welcoming Pence to the event—“I’d be honored to have him there,” the president-elect said—Biden is replicating a common divide-and-conquer counterterrorism strategy that amplifies distrust and leads to paranoia among those who remain inside an extremist group. Companies such as American Express are pulling support for members of Congress who went along with Trump’s effort to block the certification of the electoral vote.
The way to unite this country is to isolate acts of violence—and a leader who incites it—from legitimate expression. Trump was a north star for a certain kind of radical. Americans will be safer the more that star loses its shine.
