According to their own law. There is no way for them to actually counter if companies just ask someone to “self-identify as X”

“from an underrepresented community” means an individual who self-identifies as Black, African American, Hispanic, Latino, Asian, Pacific Islander, Native American, Native Hawaiian, or Alaska Native, or who self-identifies as gay, lesbian, bisexual, or transgender.”

“Female” means an individual who self-identifies her gender as a woman, without regard to the individual’s designated sex at birth.

So theoretically companies can literally have an all white blonde hair blue eyed straight male board. But as long as enough of them “self-identities” as whatever the law requires there to be. The government can’t do shit. Since there’s literally no legal framework to determine the limits or validity of “self-identification”
