The article says he is charged with felony murder, but this seems to be false. The author is apparently confused as to the difference between the felony called murder and 'felony murder' (which is murder in the commission of a crime if I understand it correctly).

"Felony murder" is an unintentional death that happened as a consequence of your felony. If Brandt had robbed a bank and Ellingson had been run over in the aftermath, that would be felony murder, but since Brandt specifically wanted to kill Ellingson it's just plain murder.
Murder 1 is when you intend to kill someone. Murder 2 is when you don't exactly intend it, but close enough.
Felony murder is when you kill someone during the commission of a felony, regardless of intent.

Stupid and makes this sus. Overlapping charges is perfectly normal and always the competent thing to do because if the heavier charge doesn't stick you can't re-introduce the lighter one.
